License & Warranty

Upon receipt of final payment, you are granted a license to use a single copy of Dictator CMS with your web site. You may continue to use Dictator CMS on upgrades, redesigns, or revisions of your web site provided they do not require modifications to the Dictator CMS source code. You may not view, modify, disassemble, make copies of (except for backups), or repurpose any part or whole of the Dictator CMS source code in any way. Nor may you allow any other party to view, modify, disassemble, make copies of, or repurpose any part or whole of the Dictator CMS code in any way.

The Dictator CMS core source code includes all files located in the “core” folder and all files ending with “.php”. You may not edit or modify these files without written permission from Ryan Cramer Design, LLC. Modification of these files prevents RCD from being able to install software fixes/upgrades and results in expiration of your license to use the software. You may however modify files produced specifically for your site with the “.html” or “.css” extensions, and these files contain all elements specific to your site’s design. You may also modify bitmap image files that are not related to the administration portion of Dictator CMS. These files and folders may be specifically outlined upon request.

Limited Warranty*

Ryan Cramer Design, LLC warrants that, as of the date on which Dictator CMS (and any customizations) is delivered by RCD and for 365 days thereafter, the software will provide the features and functions described in the estimate and shown in the Dictator CMS demo and that the software will be free from defects in materials and workmanship. Ryan Cramer Design, LLC’s entire liability and Your exclusive remedy under this limited warranty provided will be, at Ryan Cramer Design, LLC’s option, to attempt to correct or work around errors, or to refund the license and custom programming fees paid to Ryan Cramer Design, LLC and terminate this Agreement. The limited warranty is void if failure of Dictator CMS has resulted from accident, abuse, negligence, misapplication, changes on the server, or failure to use the software in accordance with the Dictator CMS documentation. Any replacement software will be warranted to the original licensee for the remainder of the original warranty period, or 90 days, whichever is longer.

In no event shall Ryan Cramer Design, LLC be liable for any special, indirect, consequential, exemplary, or incidental damages whatsoever, Including, without limitation, damage for loss of business profits, business interruption, loss of business information, loss of goodwill, or other pecuniary loss whether based in contract, tort, negligence, strict liability, or otherwise, arising out of the use or inability to use Dictator CMS (and any customizations), even if Ryan Cramer Design, LLC has been advised of the possibility of such damages. Other than as specified in this limited warranty, there are no warranties, expressed or implied, whether of merchantability, fitness for a particular purpose, or otherwise.

*Support, warranty, and upgrades are contingent upon Ryan Cramer Design, LLC’s ongoing access to your Dictator installation. We are unable to support, warrant, or upgrade installations where we do not have access to do so.
